1. Agreement to Terms
These Terms of Service ("Terms") constitute a binding agreement between you and Aegis Brightsmark Capital MB ("we", "us", "our"), company code 307576279, with registered office at Sembu 6, Buivydiskes, LT-14166, Vilniaus raj., Lithuania.
By creating an account or using The Living Chronicle (the "Service"), you agree to these Terms. If you do not agree, do not use the Service.
2. Description of the Service
The Living Chronicle is an AI-driven serialized narrative game. The Service includes:
- Daily AI-generated story chapters
- Investigation and voting mechanics
- Faction-based gameplay
- Community features (covens, theories)
- Companion AI integrations
- Associated mobile apps, web platforms, and podcasts
3. Eligibility
You must be at least 13 years old to use the Service. Users aged 13-17 in the European Union may require parental consent depending on their country of residence. By using the Service, you represent that you meet these requirements.
4. Your Account
4.1 Account Creation
You must provide accurate and current information when creating an account. You are responsible for maintaining the confidentiality of your credentials and all activities under your account.
4.2 One Account Per Person
Each person may maintain one account. Multiple accounts are prohibited except for good-faith testing.
4.3 Account Termination
You may delete your account at any time through the in-app settings. We may suspend or terminate your account for violations of these Terms, with notice where practicable.
5. License to Use the Service
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes. This license does not include:
- Modification, reverse engineering, or decompilation of the Service
- Automated access (bots, scrapers)
- Use for commercial purposes without written permission
- Resale or redistribution of any part of the Service
6. Intellectual Property
6.1 Our Content
All content generated by the Service — including story chapters, characters, locations, artifacts, artwork, music, sound effects, and game mechanics — is the intellectual property of Aegis Brightsmark Capital MB. While the content is AI-generated, we assert copyright on the work through editorial curation, selection, and direction.
6.2 Your Content
You retain ownership of theories, discussion posts, and other user-generated content you create. By submitting content to the Service, you grant us a worldwide, royalty-free, non-exclusive license to display, distribute, and use that content within the Service.
6.3 Fair Use
We encourage fan content, theories, commentary, and reviews. Non-commercial fan use of characters, locations, and story content is permitted, provided you do not claim ownership or imply endorsement.
7. Purchases and Payments
7.1 Subscriptions
Chronicle+ (monthly) and Season Pass are delivered through Apple App Store and Google Play Store subscription systems, managed via RevenueCat. Prices are displayed in your local currency.
7.2 In-App Purchases
Consumable purchases (Action Point refills, cosmetic skins) are final and non-refundable once delivered, except as required by law.
7.3 Season Pass Refunds (EU Consumer Law)
EU consumers may request a refund for a Season Pass within 14 days of purchase, provided they have not used any premium features. This right is waived upon first use of premium content.
7.4 Subscription Refunds
Subscription refunds are handled through Apple App Store or Google Play Store refund policies, not directly by us.
7.5 Drop Rate Transparency
The variable rewards in investigation outcomes follow published drop rates. See our Drop Rate Transparency page for exact percentages. Drop rates are identical for free and paid Action Points.
8. User Conduct
8.1 Prohibited Activities
You agree not to:
- Use the Service for any illegal purpose
- Harass, threaten, or abuse other users
- Post hate speech, discriminatory content, or content promoting violence
- Impersonate others or misrepresent your identity
- Attempt to gain unauthorized access to accounts or systems
- Use cheats, exploits, or bots
- Reverse engineer or attempt to extract source code
- Violate intellectual property rights
- Circumvent content moderation
8.2 Community Features
Theories, coven messages, and discussions are subject to our Acceptable Use Policy. Violations may result in content removal, account suspension, or termination.
8.3 Moderation
We reserve the right to moderate user-generated content. We may remove content or suspend accounts that violate these Terms, with or without notice.
9. AI-Generated Content Disclaimer
The Service uses AI models (Anthropic Claude and Google Gemini) to generate story content. While we curate and review content for quality, the AI may occasionally produce imperfect or stylistically inconsistent output. See our AI Disclosure for full details.
10. Service Availability
We aim to provide reliable service but do not guarantee uninterrupted availability. The Service is provided "as is" and "as available". We may modify, suspend, or discontinue the Service at any time.
In the event of service disruption affecting paid subscribers, we will provide prorated refunds or compensation at our discretion.
11. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" without warranties of any kind
- We are not liable for indirect, incidental, consequential, or punitive damages
- Our total aggregate liability is limited to the amount you paid in the 12 months preceding the claim
- Some jurisdictions do not allow limitations on implied warranties or liability; these limitations may not apply to you
12. Indemnification
You agree to indemnify and hold harmless Aegis Brightsmark Capital MB from any claims arising from your use of the Service or violation of these Terms.
13. Dispute Resolution
13.1 Governing Law
These Terms are governed by the laws of the Republic of Lithuania, excluding conflict of laws principles.
13.2 Jurisdiction
Any disputes will be resolved in the courts of Vilnius, Lithuania.
13.3 EU Consumer Rights
EU consumers may access the Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr/ for disputes. Consumer rights under your local law remain unaffected.
14. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via in-app notification and email at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance.
